In the event this agreement is not accepted by the Owner, within 7 days, the total deposit received will be refunded. This agreement, made the ___ day of _____, 20__ between Robbie Davis (Owner), and ________ as Tenant, Witnessed that the Owner has leased to the Tenant the Property situated at _______________________________________________________________, for the term beginning the ____ day of ______, 20__ and ending the ____ day of ______, 20__ at 04:00 PM to be used and occupied for dwelling purposes only for _____ persons and no more; upon the conditions and covenants following:

Surrender:

The Tenant shall take good care of the premises and the furniture and chattels therein contained, and at the end or sooner of termination of the term shall deliver up the premises and furniture and chattels in as good state and condition as they were in at the commencement of the term, reasonable use and wear thereof accepted. The Tenant further agrees to vacate said premises upon expiration of said lease.

Rent:

The Tenant shall pay the rent for said premises in advance of occupancy. Rent shall be as follows; $________ USD of said rent shall be due at the time of execution of this agreement, and the balance of said rental amount shall be due and payable no less than one month prior to the date of occupancy. In the event that said rental amount is not paid as provided above, said lease shall be null and void. In the event of cancellation of said rental, the Tenant shall be entitled to a refund of rental deposit only if said cancellation occurs 30 days or more prior to the agreed occupancy date. The rental amount shall be paid as follows:

Security Deposit:

The Sum of _______ (US funds) for property located at _____________; will secure the performance of the Tenants obligations. The security deposit is refundable, if there is no damage and the unit is left in a clean condition. The balance of the deposit will be refunded within two weeks (14 days) from the date possession is delivered back to the Owner or their authorized agent, together with a statement showing charges, if any, made against such deposit.

Cleaning Fee:

A charge of $95.00 will be applied to all Phoenix rentals and a $65.00 for the West Palm Beach rental. Anyone staying longer than one month may be required to have one additional cleaning per month.

Utilities:

Owner will be responsible for the payment of all utilities and services unless otherwise stated as extra charge for excessive use.

Pointe Resort Home Owners Association:

Tenant agrees to abide by all the rules of the Owner�s Association including rules with respect to smoking, noise, odors, disposal of refuse, animals, parking, and the use of common areas. Phoenix point Homeowners association does not allow use of Barbeque grills except in designated common areas.

Access to Premise:

The Tenant agrees that the owner or his representative shall have the right to enter into and upon the premises, or any part thereof, at all reasonable hours for the purpose of examining the same, or making such repairs or alterations therein as may be necessary for the safety and preservation thereof.

Damage by Fire:

The Tenant shall, in case of fire, give immediate notice thereof to the Owner who shall cause the damage to be repaired forthwith; but if the premises be so damaged that the premises requires rebuilding, the term shall cease and the accrued rent be paid up to the time of the fire.

Assignment:

The Tenant shall not assign this agreement, or sublet the premises, or any part thereof, or make any alterations in the premises, nor permit the same to be used at any time during said term for any purpose other than above mentioned, without the written consent of the Owner.

Damages:

Except for reasonable wear and use as described above, the Tenant shall be responsible for any damage, theft, or loss occurring to said premises, furniture, or chattels located thereon during their occupancy of said premises. This includes tenant�s personal property.

Pets:

No animal or pet of any kind shall be kept on or about the premises. If found this will result in automatic forfeiture of deposit.

Smoking:

No smoking of any kind is allowed inside the unit at any time. If found will result in automatic forfeiture of deposit.

Liability:

The Tenant shall hold the Owners harmless from any liability for accidents, injuries, or damages sustained by said Tenant, any family member, guest, or invitee of said Tenant, while occupying said premises.

No Oral Change:

This instrument may not be changed, modified, or discharged orally. It is further agreed that the covenants and agreements contained herein are binding on the parties hereto and their legal representatives.
